This is just not nice. It's not even hurting the right kind of people that Apple means to hurt. This is like being jealous about Bruno at a bar taking your girlfriend away from you and you kicking a dog outside for having the same name. Uhm, come on, Apple! Geez.

heh, interesting choice of analogies..

and it's not like they invented the word pod =.= .. for example, the self storage people you see on tv all the time: http://www.pods.com/storage/intro.aspx

for those in the music business and particularly the mp3 player business - they might have some ground to stand on.. but not on products totally unrelated. Just another example of why patents and trademarks are evil.

I'd just like to go on the record and say I am really appalled by Apple lately. This might only be one data point but here's my stupid Apple rant:

I was interested in getting an iPod for my mother for x-mas last year. My gfnd and I went to the local Apple store, during the x-mas rush. I was expecting to see the normal level of craziness and sure enough it was kind of a mad-house but nothing more than I would have expected. But rather than simply having the iPods on a shelf where I could just go up and grab one and go to the counter there was an "iPod lane". I looked around to find someone to help me and there wasn't anyone willing to talk to me. All the employees were engrossed in doing their own non-customer related crap - despite the 20 people helplessly waiting in a motionless line. I went up to the counter and asked if I could just buy a iPod and the woman was extremely rude to me telling me that I was in the service line, and that I'd have to get into the rather annoyingly long iPod queue.

So we queue up and after several minutes of not moving one of the women stood up and yelled, "If anyone has made an appointment for service please come up here." An appointment to fix your crap product?! No one had an appointment and why weren't they helping the customers if they had nothing better to do? I was well beyond annoyed. The pompous attitude was way way over the top.

I thought carefully about having a full fledged hissy fit right there in the Apple store but reconsidered as I realized there would be absolutely no one who understood why what was happening right there in the store was completely and impossibly wrong. We aren't slaves!! We weren't there because we had to be there - it's not like I'm at the DMV where they hold me by the driving balls. I wanted to get something fun for my Mother. I didn't have to buy an iPod, she didn't want one anyway. At that moment, I looked and my gfnd and told her, "I am disgusted. I am morally opposed to being treated like cattle when I'm trying to give someone my money. Let's go." That's right. I voted with my dollars and left the store to go buy something that my Mother would actually like.

Then a few months later I get a free iPod nano from my Father who got it for free at work and then a few weeks later I get another free iPod nano for doing some crazy stuff at work too. Okay, free isn't so bad. So I take my Father's and try to get it working. I install iTunes, try to upload music. Does it work? Nope. There's really no way to even know what's wrong with it because it doesn't even have an interface. But after toying with it endlessly I realize it's completely faulty. It won't even turn on properly. Into the trash it goes - cuz there's no way I'm paying to fix that piece of crap.

Second one? Okay it works. Oh, right, it can't read Mp3s natively, it has to convert them to it's evil format of doom. Hours and hours later I can finally listen to music. Then I realize it's only got enough space for about 1/15th of the music I want. And now I have two copies of each file - talk about wasteful. At this point I give up and go back to using my phone which is a) easier to use b) holds more music and c) doesn't force me to convert every file I have into proprietary formats. So I give it to my gfnd. She hates it too. Now she's using her phone too. Muuuuuch better.

I'm never going to buy an Apple product for the rest of my days if I can possibly help it.

I hope someone registered "Apple" as trademark in the sixties, but did not tell, and sue them clean.

it would be interesting if someone could claim prior use for 'pod' and win a suit against them.. if they win, i think they'd be able to re-sue them for all the profits they've gained from sueing other companies over trademark infringement they didn't have rights to..

just wishful thinking though..
